Rogue Wave Software, Inc. (“Rogue Wave”) grants you a non-exclusive, non-transferable, limited right to access and view the contents of the public discussion forums (“Forums”). The AUP (Acceptable Use Policy) can be modified at any time, and continued use of the Forums indicates your acceptance of the modified terms that can be found at https://forums.roguewave.com/faq.php?faq=vb3_board_faq#faq_usepolicy.

ROGUE WAVE WILL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES, OR FOR ANY ECONOMIC OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS). INFORMATION IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, OR WARRANTIES REGARDING ACCURACY, AVAILABILITY, RELIABILITY, TIMELINESS OR SECURITY. ROGUE WAVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR THAT THE FORUMS ARE FREE FROM VIRUS OR OTHER DESTRUCTIVE PROPERTIES.

Any message posted on the Forums expresses only the views and opinions of the author of the message and does not necessarily reflect the views of Rogue Wave. Rogue Wave employees are free to express their own personal views in the Forums that are not necessarily the views of Rogue Wave. The exception is public announcements posted in the Forums by Rogue Wave in the designated announcements section. All comments and materials submitted to the Forums shall be considered non-confidential and the property of Rogue Wave. Moderators and administrators designated by Rogue Wave are used to monitor the content and appearance of messages posted in the Forums. The real-time nature of such public discussion makes it impossible for Rogue Wave to monitor and review every message. Therefore, you agree that Rogue Wave will not be held responsible for the contents, accuracy, completeness or validity of any information posted in them.

You agree that you will not use the Forums to post any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violating any law. You agree that you will not post any copyrighted material without the express permission of the copyright holder, unless such copyright is owned by you. Solicitations of consulting services or third-party advertisements including related or unrelated products and services of any kind are not acceptable in the Forums.

Rogue Wave has the ability to edit and/or remove objectionable messages. Any user who believes that a posted message is objectionable is encouraged to contact the administrator immediately by email forums@roguewave.com. Upon receipt of such notification, Rogue Wave will make every effort to take such action as deemed necessary within a reasonable period of time. Since this is a manual process, you are advised that Rogue Wave may not be able to remove or edit particular messages immediately.

Rogue Wave reserves the right to edit or delete any message for any reason whatsoever, at our sole discretion. You agree that you are solely responsible for the content of your messages and that you will indemnify and hold harmless Rogue Wave, these Forums, and their agents and employees with respect to any claim based upon the appearance and/or transmission of your message(s).

In the event of any complaint or legal action arising from any message posted by you, Rogue Wave reserves the right to reveal your identity and any other information we may know about you.

Participation in the Forums is voluntary by you, other individual participants and Rogue Wave. Rogue Wave offers paid technical support through Maintenance and Support Agreement. Should questions posted in the Forums require significant research or significant technical expertise, Rogue Wave may suggest contacting the Software Support Team directly for a one-on-one discussion. A Maintenance and Support Agreement must be in place to take advantage of this service; inquiries regarding a Maintenance and Support Agreement can be sent to sales@roguewave.com.
